FIX I.T. – Terms and Conditions of Service

These Terms and Conditions govern all services and products provided by FIX I.T. Computer and Laptop Repairs (“FIX I.T.”, “we”, “us”, “our”) to any customer (“Customer”, “you”). By requesting, accepting, or making use of any services or products supplied by FIX I.T., the Customer agrees to be bound by these Terms and Conditions.
1. DEFINITIONS & INTERPRETATION
1.1 The singular includes the plural and vice versa.
1.2 Any reference to a gender includes all genders.
1.3 References to natural persons include juristic persons and vice versa.
1.4 “Services” include, but are not limited to: diagnostics, repairs, maintenance, consulting, networking, data recovery, software installation, cloud services, cybersecurity-related assistance, and IT support.
1.5 These Terms constitute a binding agreement once accepted verbally, electronically, or in writing by the Customer and FIX I.T.
2. QUOTATIONS, RATES & TURNAROUND TIMES
2.1 All quotations are estimates and valid for 10 (ten) business days, unless stated otherwise.
2.2 Turnaround times are estimates only and are not guaranteed.
2.3 FIX I.T. reserves the right to amend pricing due to supplier cost increases, currency fluctuations, or unforeseen technical complexity prior to acceptance.
2.4 Additional work not included in the original quotation will only be undertaken with Customer approval and may incur additional charges.
3. BOOKINGS, CANCELLATIONS & NO-FIX-NO-FEE
3.1 Appointments cancelled with less than 24 hours’ notice may be billed in full or in part at FIX I.T.’s discretion.
3.2 The “No Fix, No Fee” policy applies only to private/home users and excludes:
- Business clients
- Data recovery
- Diagnostics
- Software-related issues
3.3 Diagnostic and inspection fees are payable regardless of outcome unless otherwise agreed in writing.
4. PAYMENT TERMS
4.1 Payment is due immediately upon invoice unless otherwise agreed in writing.
4.2 FIX I.T. reserves the right to withhold devices, data, or services until full payment is received.
4.3 Interest on overdue amounts will accrue at 9% per annum, calculated daily and compounded monthly.
4.4 All legal and collection costs incurred due to non-payment shall be payable by the Customer on an attorney-and-own-client scale.
5. DATA, BACKUPS & DATA LOSS
5.1 The Customer is solely responsible for ensuring that all data is backed up prior to handing over any device.
5.2 FIX I.T. is not liable for data loss, corruption, or breaches arising during diagnostics, repairs, upgrades, malware removal, or system reinstalls.
5.3 Backup services are available on request and will be charged separately.
5.4 Data recovery services are provided on a best-effort basis with no guarantee of success.
6. LIMITATION OF LIABILITY
6.1 FIX I.T. shall not be liable for any failure or delay caused by factors beyond its control, including but not limited to:
- Hardware age or condition
- Software incompatibility
- Manufacturer defects
- Internet Service Provider failures
- Third-party platforms, cloud providers, or licensing systems
6.2 To the maximum extent permitted by law, FIX I.T. shall not be liable for any:
- Loss of data
- Loss of income or profits
- Business interruption
- Cyber incidents, hacking, ransomware, or malware
- Indirect, incidental, or consequential damages
6.3 All services are provided “as is” and “at own risk”.
7. CONFIDENTIALITY & POPIA COMPLIANCE
7.1 FIX I.T. will take reasonable steps to maintain confidentiality of Customer data.
7.2 FIX I.T. complies with the Protection of Personal Information Act (POPIA) and will not intentionally disclose personal data without lawful justification.
7.3 FIX I.T. is not responsible for pre-existing malware, spyware, illegal content, or compromised systems.
7.4 FIX I.T. reserves the right to refuse service where illegal, unlicensed, or prohibited content is found.
8. WARRANTIES & PRODUCTS
8.1 Products are supplied subject to the manufacturer’s warranty, where applicable.
8.2 Where no warranty exists, goods are supplied voetstoots, as permitted under South African law.
8.3 FIX I.T. provides no warranty on third-party software, updates, or operating system changes.
8.4 FIX I.T. is not liable for defects caused by misuse, abuse, neglect, power surges, liquid damage, or unauthorised repairs.
9. CUSTOMER RESPONSIBILITIES
9.1 The Customer confirms that they are the lawful owner or authorised user of any device submitted.
9.2 The Customer must provide accurate passwords, licenses, and credentials where required.
9.3 The Customer warrants that all data and software are lawfully obtained.
10. ABANDONED GOODS
10.1 Any device or item not collected within 90 (ninety) days of notification will be deemed abandoned.
10.2 FIX I.T. reserves the right to sell or dispose of abandoned goods to recover outstanding costs.
11. CREDIT CHECKS & DEFAULT LISTING
11.1 The Customer consents to credit checks and reporting to credit bureaus where applicable.
11.2 Outstanding accounts may be listed as defaults until settled.
12. RETENTION OF OWNERSHIP
12.1 All products supplied remain the property of FIX I.T. until paid for in full.
12.2 FIX I.T. reserves the right to repossess unpaid goods without prior notice, as permitted by law.
13. FORCE MAJEURE
FIX I.T. shall not be liable for failure to perform due to events beyond its reasonable control, including acts of God, load shedding, strikes, cyber incidents, or legislative changes.
14. DISPUTES & GOVERNING LAW
14.1 These Terms are governed by the laws of the Republic of South Africa.
14.2 The Customer consents to the jurisdiction of South African courts.
15. GENERAL
15.1 These Terms constitute the entire agreement between the parties.
15.2 No variation shall be valid unless reduced to writing and signed by both parties.
15.3 If any provision is found invalid, the remaining provisions shall remain enforceable.
15.4 FIX I.T. reserves the right to update these Terms from time to time.
By proceeding with any service or purchase, the Customer acknowledges that they have read, understood, and accepted these Terms and Conditions.
